At an adjourned meeting of the Council for the Town of Chatham, held in the
Chatham Town Hall, at 6:00P.M. on July 22, 2009.
Present: Robert B.
Thompson, Vice Mayor
Council Members: Roy Byrd, Jim McDole, and Joe
Rogers.
Absent: Alvin Crider, C.B. Cundiff, and Mayor George
Haley.
Attorney: Larry Gott.
Council on
motion by Byrd and seconded by McDole approved the agenda.
The Vote: Aye: Council Members; Thompson, Rogers,
McDole, and Byrd.
Councilman
Rogers reported that the Water and Sewer Committee met since the last session
and recommends to council accepting the bid of Reynolds-Clark to perform the
Dam Break Analysis for the fee of $54,846.00.
The Vote: Aye: Council Members; Thompson, Rogers,
Byrd, and McDole.
Councilman
Rogers presented to Council a proposal from TigerTek Industrial Services to
repair clarifier #2 at the sewer plant for $12,456.48. He stated that the Water
and Sewer Committee recommends accepting this bid and delaying repairs to
clarifier #1 until the next fiscal year.
The Vote: Aye: Council Members; Rogers, McDole,
Thompson, and Byrd.
Attorney
Larry Gott explained to council that due to the nature of the transaction of
acceptance of the Old Chatham Elementary School property from Pittsylvania
County that council cannot hold pre-discussions in a closed meeting. The
transaction does not contain any of the exemptions allowed by the Freedom of
Information Act.
A motion was made by McDole seconded by Byrd to
request a full disclosure and clarification from the County concerning the
school property.
The Vote: Aye: Council Members; McDole, Byrd,
Thompson, and Rogers.
Council on motion of
Rogers and seconded by McDole adjourned to closed session for the purpose of
CONSULTATION WITH LEGAL COUNCIL AND BRIEFINGS by Staff Members or Consultants
Pertaining to Actual or Probable Litigation, Where Such Consultation or
Briefing in Open Meeting Would Adversely Affect the Negotiating or Litigating Posture
of the Public Body; and Consultation with Legal Counsel Employed or Retained by
a Public Body Regarding Specific Legal Matters Requiring the Provision of Legal
Advise by Such Counsel. Authority:
Section 2.2-3711 (A) (7) of the Code of Virginia, 1950, as amended.
The Vote: Aye: Council Members; Byrd, Rogers,
Thompson, and McDole.
Council on
motion of McDole and seconded by Byrd returned to regular session.
The Vote: Aye: Council Members; Thompson, Rogers,
Byrd, and McDole.
EXECUTIVE SESSION CERTIFICATION
Whereas,
the Town of Chatham has convened an executive meeting on this date pursuant to
an affirmative recorded vote and in accordance with the provisions of the
Virginia Freedom of Information Act; and
Whereas,
§2.2-3712 of the Code of Virginia requires a certification by this Council of
the Town of Chatham that such executive meeting was conducted in conformity
with Virginia law;
Now,
THEREFORE, BE IT RESOLVED that the Council of the Town of Chatham hereby
certifies that, to the best of each member's knowledge, (1) only public
business matters lawfully exempted from open meeting requirements by Virginia
Law were discussed in the executive meeting to which this certification
resolution applies, and (ii) only such public business matters as were
identified in the motion convening the executive meeting were heard, discussed
or considered by the Council of the Town of Chatham.
Council on
motion of McDole and seconded by Rogers certified the closed session.
The vote: Aye; Council members; McDole, Vice Mayor
Thompson, Byrd, and Rogers.
On a
motion by Rogers seconded by Byrd council approved referring the Roaring Gap
Dam complaint to insurance carrier VML.
The Vote: Aye: Council Members; Rogers, Byrd,
Thompson, and McDole.
Having no
further business council was adjourned.
